These Terms of Use ("Terms") govern the use of the Waiterwave platform, operated by Michał Wojciechowski Waiterwave, registered in Poland at woj. MAZOWIECKIE, pow. Warszawa, gm. Warszawa, miejsc. Warszawa, ul. Kwitnąca, nr 11, lok. 29, 01-926, with tax ID 1182302031. By accessing or using the Waiterwave platform, users acknowledge their agreement to these Terms. The platform serves as a digital meeting point for waiters seeking job opportunities and restaurants in need of staff, ensuring a seamless and efficient connection between the two parties.
To ensure the integrity of the platform, all users must provide a valid email address for login. Each waiter and restaurant location is permitted only one account, ensuring clear and accountable interactions. In the case of chain restaurants, each physical location must have a separate account, preventing centralized management under a single login.
For restaurant accounts, additional verification measures apply. Restaurants are required to submit accurate business details, including a valid address and tax ID. Waiterwave reserves the right to review this information and, if discrepancies or fraudulent data are identified—either through internal checks or user reports—the platform may suspend or disable the account following a verification process.
Waiterwave offers a paid membership model for restaurant users, granting access to the platform through the dedicated web app, while waiters can use the mobile app free of charge. Upon registration, payment details are securely collected via Stripe, although no charge is applied immediately. Instead, new restaurant accounts benefit from a one-month free trial, after which the first payment is processed.
Restaurant users can cancel their subscription at any time, retaining full access until the end of the current billing cycle. However, refunds are not provided, ensuring a fair and transparent system. Additionally, by proceeding with the first payment, users explicitly waive their 14-day statutory withdrawal right, as the service is immediately accessible upon payment.
Waiterwave acts solely as a facilitator by providing a platform where waiters and restaurants can connect. The company does not guarantee employment, payment, or the quality of service provided by either party. Users are responsible for conducting their own due diligence, and waiters are strongly encouraged to verify a restaurant’s legitimacy before accepting job offers. To maintain neutrality, Waiterwave is not liable for any disputes that arise between users. Any conflicts must be resolved directly between the involved parties, as the platform does not mediate or enforce agreements made outside its system.
By using the platform, users agree that Waiterwave has the right to display, edit, and remove content such as profile details, messages, and uploaded images when necessary to maintain compliance with the Terms. Additionally, restaurant profiles may be featured in marketing materials, unless the restaurant explicitly opts out of such promotions.
If any content is found to be in violation of these Terms, Waiterwave will provide prior notice via email before proceeding with removal, ensuring transparency in moderation actions.

Waiterwave reserves the right to update these Terms as necessary. In the event of major changes, users will be required to explicitly accept the updated terms via a pop-up notification before continuing platform use. Minor changes will be communicated through email or in-app notifications, and continued use of the platform following such updates will constitute acceptance of the revised Terms.
These Terms are governed by the laws of Poland. In case of disputes, users are encouraged to first seek resolution through arbitration or mediation before resorting to formal legal proceedings in Polish courts.
